Welcome to ServMe. These Terms of Service ("Terms") govern your access to and use of the ServMe website (servme.my), application (app.servme.my), and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Account Responsibilities

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password.

As a merchant using our Platform to process orders, you take full responsibility for the legality, quality, and delivery of the goods, food, or services you provide to your customers. ServMe is strictly a technology provider and does not assume any liability for fulfilling your customer orders.

2. Subscriptions and Payments

Some parts of the Platform are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (e.g., monthly or annually). At the end of each period, your Subscription will automatically renew under the exact same conditions unless you cancel it or ServMe cancels it.

All payments are processed securely via our third-party payment gateway (Stripe). You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Platform.

3. Acceptable Use Policy

You agree not to use the Platform to:

  • Violate any applicable national or international law or regulation.
  • Sell illegal, restricted, or hazardous goods.
  • Exploit, harm, or attempt to exploit or harm minors in any way.
  • Infringe upon the rights of others, or in any way that is illegal, threatening, fraudulent, or harmful.
  • Attempt to reverse compile, disassemble, reverse engineer or otherwise reduce to human-perceivable form all or any part of the Platform.

4. Intellectual Property

The Platform and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of ServMe and its licensors. The Platform is protected by copyright, trademark, and other laws of Malaysia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ServMe.

5. Limitation of Liability

In no event shall ServMe, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Platform.
  • Any conduct or content of any third party on the Platform.
  • Any content obtained from the Platform.
  • System downtime, network failure, or platform unavailability resulting in lost revenue or lost orders.

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind.

6. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms or non-payment of subscription fees.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
